Please read these Terms & Conditions carefully before ordering goods from the website of MyExpatShop. By using the website to place an order, you accept to be bound by the Terms & Conditions of this agreement.

General

The client’s statutory rights are in no way affected by these Terms & Conditions.

MyExpatShop and MESGroup SA shall be excluded from any liability of any kind due to any cause which is beyond our reasonable control. This includes, but is not limited to, acts of God, national acts, industrial action, war, explosions, information system failures including telecommunications, floods, fires and failure of third parties such as delivery services.

Should any part of this agreement be found to be void or unenforceable, the remainder of the agreement will remain valid.

We may change the Terms & Conditions at any time and it is the client’s responsibility to check what alterations have been made. Continuing to use our site after any changes will constitute the client’s acceptance of the changes. Any part of this site, including part or all of the content, may be suspended, changed or terminated at our complete discretion.


Links provided on our website may lead to other sites. However, we cannot be held responsible for any aspect of these sites insofar as MyExpatShop has no control over them or their contents. It is perfectly conceivable that MyExpatShop does not endorse part or all of the contents of linked sites.

Orders

Your order will be confirmed to you by email. Our mail will include the name and delivery address as well as the cost of the order in terms of goods to be shipped and delivery costs. All weights, volumes, etc., published on our site are obtained from our suppliers and are, we believe, correct. The shipping weight allows for packaging and shipping materials plus the weight of the product(s) to be shipped.

We believe that the prices on our website are correct at the time of loading and we do our utmost to keep our prices fully current. However, we cannot be held responsible if errors occur and will inform you if any such error is found in your order. At that time we will give you the choice of accepting the corrected price information or cancelling your order. In the latter case, we will of course offer a full refund if money has already been paid.

Financial Information

Please be aware that, in the interests of privacy and confidentiality, we do not store any credit card details. In fact, we never ask for, receive or have access to any such details. When you pay for goods using services such as Paypal or a Credit Card, the information you provide is not seen or stored by MyExpatShop.

Order Completion

Should we, for whatever reason, find ourselves in a position such that we cannot complete your order, we will contact you (please make sure you provide valid, current information when placing your order), to discuss either an alternative product or cancelling all or part of the order. In the latter case, we will offer a refund of any balance. Proceeding through the electronic checkout of the site implies acceptance of the delivery cost proposed by our system.

Discounts

We often make special offers which our registered clients have access to. Additionally, we may make an agreement with a group that will allow them, using an access code, to benefit from other offers. If you represent a group or entity which you feel may be eligible to apply for a discount, please use the contact form and we will answer you as soon as possible.

Taxes / Duties

MyExpatShop provides a proximity service and, as such, ships only within Switzerland where all import duties and local taxes have already been paid.

Limitation of Liability and Risk

We will not be held directly or indirectly responsible for any damage, loss or injury which occur due to the use of our services or this agreement. Upon delivery by us to a carrier, or upon collection by a carrier, all risk passes to the customer. We cannot therefore accept responsibility for any loss or damage during transport.

Cancelling an order is not normally possible once it has been placed using the website and in no circumstances if the order is already more than two days old. In exceptional circumstances, at our complete discretion and if the request is received before shipment of the order, we will endeavour to cancel your order and refund you in full. We may claim out of pocket expenses if any have been incurred.

It is not possible to guarantee 100% availability of our website. Consequently, any loss of any nature due to this phenomenon will not be our responsibility. Although we endeavour at all times to provide a safe website and system, we cannot be immune to the modern day pirates, more commonly called hackers. Therefore any loss or damage caused involuntarily by system crashes, errors, virus, worms, etc., on our website or in our e-mail system, shall not be our responsibility, and no compensation shall be offered.

Using our website implies that you agree to the terms and conditions contained herein.

MyExpatShop.com accepts no responsibility if minors place orders in the name of parents or guardians as we are unable to differentiate when the information provided for payment is correct.

We reserve the right to cancel any order. Should we do so, we will offer a complete refund relative to that order. We will not offer compensation for any reason whatsoever. We are subject to and will abide by the laws of Switzerland. In no case shall a claim against MyExpatShop, MESGroup SA, its managers, directors or representatives, exceed the total cost of an order.

Guarantee of Data Communication

In the light of the current state of technology, we can give no guarantee that data communicated via the Internet is error-free and/or available at all times. MyExpatShop therefore accepts no liability with regard to a constant, uninterrupted availability of our online shop, nor for technical and electronic faults occurring in a sales transaction as well as processing delays or accepting orders.

Data protection

Data collected are treated as confidential and truthful. When contact is first made, your data is collected for business and marketing purposes in the form of personal information such as last name, first name, address and e-mail address. Information is also created from the log files when you access the website. MyExpatShop makes a distinction between master data (time and date of access, etc.) and activity data (e.g. links followed, pages consulted, articles viewed, etc.). This data is may be used and analysed by us for statistical purposes, for instance to count hits and other activity.

Any data you provide such as search criteria and form data, can be saved, even if it does not form part of a completed order transaction. Data of this type is deleted on a regular basis as the system logs are overwritten. The details of your purchases may be evaluated for purely internal marketing purposes. MyExpatShop may use specific evaluations in order to determine buying groups that we can alert to relevant product offers. Regular emails with the latest news and/or promotions are sent to the email address you provide during the registration process. The customer can unsubscribe from this email at any time by clicking on the appropriate link in the email.

MyExpatShop uses Google Analytics, a web analysis service of Google Inc. Google Analytics uses cookies to evaluate use of the website and to compile reports on website activities. Details of the cookies used are in our Enabling Cookies information.

Your data are not made available to any outside entity if this is not a legal requirement. Partner companies that MyExpatShop has entrusted with processing your data in connection with an order are not specifically named but tht data is information which we are obliged to communicate in order to complet your order. Th most common example is your name and mailing address which we are obliged topass to our designated delivery company ensure delivery your goods. The latest security technology is employed to protect your data from unauthorized processing. Absolutely no liability is accepted in respect of the security of data transmitted via the Internet. Data transmitted by the MyExpatShop site are unencrypted.

Copyright and Trademarks

The contents of the MyExpatShop website including its name, its texts and its logos as well as all its graphics remain the property of MyExpatShop and/or its parent company, MESGroup SA. MESGroup SA and MyExpatShop, including their logos, are registered trade marks.

All other names and logos remain the property of their respective owners. Unless prior agreement has been obtained, reproduction of any material included on our website is not allowed.

GDPR

At the present time, this EU law does not directly affect us.

However, the following apply:

  1. do not communicate any data to anyone unless required to do so by Swiss law.

  2. Should you wish to no longer receive emails from us, please use the Unsubscribe link at the bottom of the email you received.

  3. Should you wish to know what data concerning you we are holding, please use the Contact Us link which is at the bottom of every page and we will send you the information.

  4. If you wish that we delete all data we are holding about you, please use the Contact Us link which is at the bottom of every page. We will remove all information upon request but to avoid any false reequests, we will contact you to validate your request.
